3、Qualification Requirements For Bidder
Qualifications or Performance:(1)Requirements for Qualifications of the Bidder
A.If the Bidder is a company registered within the territory of China, it shall possess a legally valid Business License of an enterprise legal person, Tax Registration Certificate, and Organizational Code Certificate, or a unified business license combining these certificates. When submitting the bid, the Bidder shall provide a scanned copy of the original document (with the originals kept available for verification).
If the Bidder is a company registered outside the territory of China, it shall provide a valid certificate of company registration.
If the Bidder is a branch company, it shall possess a legally valid business license (for those registered within China) / certificate of company registration (for those registered outside China) and an authorization letter from the superior legal entity (authorizing the branch to bid and sign contracts). When submitting the bid, the branch shall provide scanned copies of the original documents (with the originals kept available for verification).
The qualifications, eligibility and performance of the branch and its superior legal entity shall be recognized by the Procuring Entity(Company/Purchaser), while the qualifications, eligibility and performance of other branches under the same superior legal entity shall not be recognized. Only one of the branch and its superior legal entity may participate in the bid; if both participate in the bid, all their bids shall be regarded as invalid bids.
B.Bid by Agent is not accepted. The bidder shall be the manufacturer of the chromatography analyzers or the integrator / manufacturer (including the companies within the manufacturer's group responsible for sales) of analysis systems (analysis house) of the analysis system (analysis house). If the bidder is not the manufacturer of the chromatography analyzer, they must obtain a valid authorization letter from the manufacturer of the bid chromatography analyzer. If the bidder is the sales company within the same group as the manufacturer, the bidder should provide relevant documents to prove that the sales company is within the same group as the Manufacturer and it is responsible for the sales of the bid goods.
(2)Requirement for Bidder's Past Performance:
From January 1st, 2016 to the deadline for submission of the bid (subject to the signing time of the contract), the tender documents should simultaneously meet the following performance requirements (If the following two requirements are in one same contract, it can be accepted.):
① The manufacturers of the chromatographic analyzer submitted by the bidder must have at least one contract for sale of chromatographic analyzer used in ethylene oxide (EO) or ethylene glycol (EG) media , with no less than 1 set of chromatographic analyzer in each contract.
② The integrator / manufacturer of the analyzer system must have at least one contract performance of analyzer system integration (analysis house), with not less than 1 set of chromatographic analyzers in a single contract.
The Bidder shall furnish reference list in given form, and provide corresponding documentary evidence. The documentary evidence shall include 1) copies of sales contract.
The performance of the chromatographic analyzers submitted by different manufacturers within the same group (i.e., wholly-owned subsidiaries, holding subsidiaries or manufacturing plants under the same group) is regarded as the performance of the manufacturer of the bid chromatographic analyzers. The bidder should provide an explanatory letter to state that the manufacturer of the products submitted in this bid and the manufacturer of the products meeting the above performance requirements belong to the same group.
The reference evidence documents furnished by Bidder shall as least demonstrate the content as follows: Date of signing contract, contract signing page (domestic trade contracts should have signatures or seals from both parties, international trade contracts should have signatures or seals from both parties), name of manufacturer, name of goods, quantity of analyzer system or analyzer supply, medium and acceptance evidence of goods delivery signed or sealed by the user.
If the contract is an annual framework agreement, in addition to the agreement itself, the corresponding Purchase Order(s) (PO)(under which the goods were delivered) shall also be provided, and the purchase order content or PO numbering shall be associated with the annual framework agreement. Under the same annual framework agreement, one or more purchase orders corresponding to the orders shall be deemed as one valid performance.
Failure to submit the past performance certification documents, or inability to confirm that the above performance requirements are met through the performance certification documents so provided, shall be deemed as invalid performance.
The bidder shall be the manufacturer of the chromatography analyzers or the integrator / manufacturer (including the companies within the manufacturer's group responsible for sales) of analysis systems (analysis house) of the analysis system (analysis house). If the bidder is not the manufacturer of the chromatography analyzer, they must obtain a valid authorization letter from the manufacturer of the bid chromatography analyzer. If the bidder is the sales company within the same group as the manufacturer, the bidder should provide relevant documents to prove that the sales company is within the same group as the Manufacturer and it is responsible for the sales of the bid goods.
