3、Qualification Requirements For Bidder
Qualifications or Performance:(1) The Bidder must be an independent legal entity registered in accordance with the law, domestic bidder's registered capital shall be no less than RMB 50 million yuan and the bidder shall provide copies of valid business license in the bid; the foreign bidder shall provide business license or legally registered documentary evidence in the bid, and the owner's equity in the previous financial year (2019) shall not be less than EUR 6 million or equivalent value.
(2) The Bidder must provide a valid ISO9000 series certification or equivalent Quality Management System certification.
(3) The average annual turnover shall not be less than EUR 40 million or equivalent value within the last three years (2017-2019), and annual net profit for the last three years must be positive; copies of audited report and audited financial statements (including the balance sheet, income statement and cash flow statement) for the last three years (2017-2019) are required to be provided in the bid.
(4) The Bidder is required to have completed at least three (3) teaching equipment procurement projects financed by Foreign Government Loan or International Financing Organization Loan for the period of the last five (5) years (2016- Until the date of bid opening). At least two of these projects has a contract value not less than EUR 10 million or equivalent value for each (the time of final acceptance shall prevail). The Bidder shall provide documentary evidence in bids including copies of Notification of Award, contract (including but not limited to its cover page, first page showing project name, page of contract scope, date of contract signing, contract price, signature page indicating liaison person of the End-user and contact information) and Final Acceptance Certificate. All the above mentioned documents in original shall be available for further review.
(5) In the case of a bidder offering to supply the goods under the contract which the Bidder does not manufacturer or produce, the Bidder shall provide the original letter of authority issued by the goods' manufacturer/agent (in the case that the letter of authority is issued by the agent, the letter of authority from the original manufacturer to the agent shall be provided as well) for providing the goods in this bidding project in accordance with the requirements in Section 6 "Schedule of Supply".
(6) The original Bank Credit Certificate issued by the bidder's bank of deposit within 3 months before the bid opening date shall be provided, and it will be used to prove its good financial situation and reputation. The bidder's bank of deposit shall issue the Line of Credit of no less than 5 million Euro or equivalent value in RMB within 3 months before the bid opening date, the original Line of Credit Certificate shall be provided; or the copy of Credit Contract (the original shall be available for further review) signed between the bidder's bank of deposit and the bidder shall be provided and the Line of Credit shall not less than 5 million Euro or equivalent value in RMB.
(7) Bidder shall not only commit to abide by Law of the People's Republic of China on Tenders and Bids, decree No. 1 2014 issued by Ministry of Commerce, and other laws and regulations on foreign government loan; but also obey the state laws, administrative regulations, and keep good reputation and professional ethics (The Bidder shall issue a commitment with company seal in its own format).
(8) All products and service provided under the contract shall be in conformity with regulation of "Guidelines for Procurement of Goods, Works and associated Services in Financial Cooperation with Partner Countries" issued by KfW (Link: https://www.kfw-entwicklungsbank.de/International-financing/KfW-Development-Bank/Publications/), and bidder shall guarantee that products and services provided have all needed license of export ( The Bidder shall issue a commitment with company seal in its own format).
(9) The bidder shall not have any violation behavior in recent three years during foreign government loan project bidding activity or any Administrative Punishment within China. If the bidder fails to disclose the circumstances above, the bid will be rejected, and the bidder will be responsible for compensation of the delay of the contract caused by any of the above matters (The Bidder shall issue a commitment with company seal in its own format).
(10) All parties involved in a procurement process of financial cooperation financing project must ensure a fair and transparent competition and at least observe those ILO Core Labor Standards that have been ratified by the developing country. The Bidder is required to submit a Declaration of Undertaking (Please see Section 4 for the format). The Declaration of Undertaking must be signed in a legally binding manner by duly authorized representatives of the bidder and stamped by company seal. Failure to submit this declaration and non-compliance with the requirements and the format will lead to exclusion from the tender. In addition, the bidder shall take full responsibility for the authenticity of declaration content, the bid will be rejected if any non-compliance with the facts found and determined by the bid evaluation committee during the evaluation process.
